Pre-Employment Screening – Why Criminal Checks are so Important

           Employment screening is becoming a necessary part of the application process when deciding to hire new employees. It is also your due diligence as an employer to run background checks on all potential employees. This protects you against negligent hiring law suits. Part of the background screening process should include a criminal records check.  Taking a look at an applicant’s criminal past can show you if this person is a potential threat to your company and employees. It may seem like an obvious starting point when deciding on background checks for your potential employees, but let’s take a look at what can happen when an appropriate criminal background check is not completed on a potential employee.

            Frank is applying to your company to work in the call center. The position requires that the applicant will be working nights. Many of the employees who are currently working in the call center are female.  You interview Frank and he appears to be a great guy; very smart, kind and seems trustworthy. The references he provided cannot say enough nice things about him. You need to get this position filled as soon as possible so you decide to skip the background check because you have a good feeling about this guy. You make an offer and Frank accepts.

            About a month after Frank begins work you get a complaint from Anne who works in the call center with Frank. She is very upset because Frank has made some inappropriate advances to her in the break room during one of their shifts. She now feels uncomfortable working with him. Your boss hears of the complaint and asks how Frank’s criminal background check turned out. When you admit that you did not conduct one your boss asks you to have one completed right away. When the results come back you are surprised to see that multiple assault charges were found.

            Should Anne have decided to sue your company she may have had a case. Without conducting a proper background check on Frank you were not doing your due diligence to identify a possible threat to your company and employees. You did not protect yourself against negligent hiring. Should you have ran a background check on Frank to check his criminal record, you would have found that he has a history of assaulting women and therefore would not be a good choice to work with women at night. Studies have shown that past behavior in individuals is a good indicator of future behavior.  Never skip out of employment screening when hiring new employees and be sure to establish an employment screening so that criminal checks are completed on all possible employees.
